By accessing or using the Advanced Ballistic Systems (“ABS,” “we,” “us,” or “our”) website located at www.absarmor.com, or any related services, content, or platforms (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, do not access or use the Services.

ABS reserves the right to modify these Terms at any time. Changes are effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.

Use of Services

ABS provides representation, warehousing, kitting, assembly, distribution, and program support services related to defense, protective, and ballistic solutions.

The Services are intended for use by:

  • U.S. Government agencies

  • Federal, state, and local law enforcement

  • International allies

  • Authorized commercial and institutional partners

All use must comply with applicable U.S. and international laws, including export control regulations.

Intellectual Property Rights

All content on this website, including but not limited to text, graphics, logos, images, technical descriptions, specifications, and data, is the property of ABS or its licensors and is protected by U.S. and international intellectual property laws.

You may not copy, reproduce, modify, distribute, transmit, or create derivative works without prior written authorization from ABS.

User Responsibilities and Export Controls

You are solely responsible for your use of the Services and agree to comply with all applicable laws and regulations, including but not limited to:

  • International Traffic in Arms Regulations (ITAR) – 22 CFR Parts 120–130

  • Export Administration Regulations (EAR) – 15 CFR Parts 730–774

  • Office of Foreign Assets Control (OFAC) sanctions programs

ABS products, services, and technical data may be subject to U.S. export controls, including defense articles and services listed on the U.S. Munitions Import/Export Lists or controlled dual-use items.

You agree that you will not export, re-export, transfer, or disclose any controlled items or technical data without required licenses or authorizations. Unauthorized access or export is strictly prohibited and may result in severe civil and criminal penalties.

You agree to indemnify and hold harmless ABS from any claims, damages, penalties, or losses arising from your violation of export control laws or these Terms.

Disclaimers

The Services are provided “as is” and “as available.” ABS makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

ABS does not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, ABS shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of the Services.

ABS’s total liability for any claim shall not exceed the amounts paid by you to ABS in the twelve (12) months preceding the event giving rise to the claim.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.

Any disputes shall be brought exclusively in the state or federal courts located in Butler County, Ohio.

Claims under $75,000 USD shall be resolved through binding arbitration administered by the American Arbitration Association (AAA), unless you opt out in writing within thirty (30) days of first use of the Services.

Force Majeure

ABS shall not be liable for delays or failures caused by events beyond reasonable control, including acts of God, war, terrorism, government actions, labor disruptions, or supply-chain interruptions.

Severability and No Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Failure to enforce any provision shall not constitute a waiver.
